Please Note:  The Florida Insurance Licensing Association announces Florida's first 100% online insurance agent licensing course. This 40-hour course (2-15 Life, Health & Variable Annuity) is required to become an insurance agent in Florida. The 2-15 agents license allows an agent to sell all forms of life insurance, health insurance, medicare supplement, HMO, home health care, managed care and long term care policies in Florida. Where an insurance company is based or incorporated determines if it is a DOMESTIC insurer, a FOREIGN insurer, or an ALIEN insurer.  There ain't nothing to it. 

Domestic means the insurer is incorporated in the state it is doing business in.  For example, the local Blue Cross/Blue Shield is probably a Domestic insurer, no matter what state you're in.  the insurer is incorporated in the state it is doing business in.  For example, the local Blue Cross/Blue Shield is probably a Domestic insurer, no matter what state you're in. 

A Foreign insurer is incorporated or based in some OTHER state, maybe Texas or Delaware.  incorporated or based in some OTHER state, maybe Texas or Delaware. 

And an ALIEN insurer comes from out of the country some place.

Can an insurance agent sell a policy over the web to someone in another state? Boy, don't get me to lying.  It's being done but it is flat raising some hackles all around the world.  Look for a ruling in the next year or two.
Who does an insurance agent represent? The company

There are all kinds of ways to distribute sales literature.  Agents, companies, and marketers are trying direct response through the mail, inside magazines, papers, and even on television or radio. 

Franchise Marketing provides coverage to employees of small firms ot to members of associations.  This am different than group policies, anyone insured under the Franchise Marketing System gets an individual policy, even though the premiums may well be paid through the company or association.

NONINSURANCE SPONSORS are becoming more and more popular.   Look for further growth if the new insurance bill passed by Congress is signed into law.  Banks and credit card companies are the major players, but car dealers won't be far behind.  These institutions simply let their clients know that such and such a company is a good guy to get insured with.

Vending Machine Sales.. You see these at airports and other ports.  Usually you'll see a big face value coupled to a low premium, but it only lasts for a single trip.

Internet Insurance Sales?  It's happening now and there's no place for sales to go but UP.  Right now, if someone from New York stops over physically in Oklahoma s/he can be sold an insurance policy for less than if s/he was at home.  The policy and the rates will  remain in effect when s/he goes home again.  What if someone from New York stops at an Oklahoma web site?  Do Oklahoma rates apply, or New York?  The NAIC may take awhile to figure this one out.

Life and Health Agents do not, as a general rule, have the authority to issue or modify insurance contracts.  What this means is:  The agent cannot bind the insurer or guarantee coverage to the client. 

Contracts are written out by the company, the agent convinces someone the policy fits them to a T -- the application is then turned in to the company for approval. 
If all goes well the actual policy is then sent to the new policy holder and they have a specified time to evaluate the policy. 
Most states insist on a 20 day minimum; many companies grant a 30 day minimum. 

Now, Property and Casualty Agents have more to say about who gets what.  In fact, if they don't watch what their tongue slips over Property and Casualty Agents may end up binding or commiting their companies to something they didn't want no part of.  
Property and Casualty Agents  sometimes inspect risks for the insuance company, and collect premiums due as well. 
They might even be authorized to issue some types of insurance contracts directly from their own offices.

Brokers are a whole new breed of wildcat.  Brokers represent the BUYER.  Naturally they do not have the authority to bind the insurance company to anything.  They do have the authority and the obligation to strike a better deal for their clients.

Insurance Consultants are new too.  They don't even get paid a commission; they work for a fee, paid by their clients, the party to be insured. are new too.  They don't even get paid a commission; they work for a fee, paid by their clients, the party to be insured.

Solicitors are salespeople who work for an agent or a broker.  Those signs on front doors and store windows which say NO SOLICITING, I'm almost certain they refer to solicitors, not to real agents.   But you might better check with the store owner or home owner just to be sure.

Agents are acting as Fiduciary for the insurance company.  Every penny they lay hands on for the company must be accounted for.  Taking a dollar out of one pocket to make change for the company's customer is called COMMINGLING and can get you into BIG trouble.  Furthermore, in the spirit of being a fiduciary, if it comes down to risking your assets or those of the company, you will risk your own.  Since you are a fiduciary, it behooves you to write clearly, get all the accurate information possible or at least pertinent, and deliver the properly completed application in a timely manner prescribed by the issuing company.

The agent must be prepared to give the insured a logical, cohesive, understandable explanation of the policy's important benefits and provisions.  If there are any riders, changes, or amendments made to the original policy provisions the agent must make the insured aware of these changes and get the insured's signature acknowledging receipt of these amendments.

In exchange, the company will permit (and even help occasionally) the agent to act in accordance with the term's of the agent's employment contract.   The company must recognize and carry out all of the provisions of that contract.  That includes paying the agent the compensation agreed upon in the contract and reimbursing the agent for proper expenditures made in behalf of the company.

Before an insurance agent may place any kind of insurance s/he must be ___ Licensed and appointed by an insurer
Controlled business means insurance which is written to cover _____ 1: The life or interests of the licensee, or those of the licensee's relatives to the second degree
2: The interests of the licensee's employer
3: The interests of any corporation, association or partnership of which the licensee or an immediate famioly member is an officer, director, substantial stockholder, partner, associate or employee, or the lives or interests of such other officers, directors, substantial stockholders, partners or employees of such entity.
A small amount of controlled business is permitted, but must not exceed ___ 25% of the aggregate commissions earned on all business written by the applicant or licensee during the same 12-month period.
Controlled business prohibitions in this subsection do not apply to 1: title insurance agents
2: limited insurance representatives

No insurer, or agent, or surplus lines insurance broker, or limited insurance representative shall pay, directly or indirectly, any commission, brokerage, or other valuable consideration to any person for services as an insurance agent, broker or representative unless s/he has a valid license for such services.

Any person or agent who receives exclusive agency contract overrides on business in Oklahoma must be licensed as an insurance agent in Oklahoma.

All licenses issued under the provisions of the Insurance Agents Licensing Act shall not continue in force longer than 24 months.

Any license application for an insurance agent, managing general agent, or limited insurance representative shall be accompanied by a Written appointment by an officer (or attorney for) an insurer recognized and approved by the state.
The license application for an insurance agent must indicate which lines of insurance the applicant will be authorized to write for the insurer.
All appointments for any licensee must be submitted on behalf of the appointing insurer on ______ forms prescribed by the current Commissioner.
A license issued by the State of Oklahoma will contain what 5 things? 1: The name of the holder
2: the mailing address of the holder
3: the expiration date
4: the lines of insurance covered
5: such other information as the Commissioner deems proper.
